1. Acceptance of Terms

These Terms and Conditions govern your use of Kalevista's wildlife safari services and website. By booking a safari, making an inquiry, or using our website, you agree to be bound by these terms.

If you do not agree with any part of these terms, please do not use our services. We reserve the right to modify these terms at any time, with changes becoming effective upon posting to our website.

2. Definitions

"Company," "We," "Us," "Our": Refers to Kalevista, wildlife safari operator based in Kota Kinabalu, Sabah, Malaysia
"Services": Wildlife safari programs, river cruises, and related activities offered by Kalevista
"Guest," "You," "Your": Individual or entity booking or participating in our safari services
"Agreement": These Terms and Conditions, along with booking confirmations and any additional policies
"Safari": Any wildlife observation program offered by Kalevista, including dawn cruises, multi-day safaris, and expeditions

3. Eligibility and Age Requirements

You must be at least 18 years old to make a safari booking. Bookings for minors must be made by a parent or legal guardian who accepts responsibility for the minor's participation and compliance with these terms.

By booking, you confirm that you have the legal capacity to enter into this agreement and that all information provided is accurate and complete.

4. Booking and Confirmation

4.1 Booking Procedure

Safari bookings can be made through our website contact form, email, or phone. Bookings are subject to availability and confirmation by Kalevista.

4.2 Booking Confirmation

A binding contract is formed when we send written confirmation (email) of your booking, which will include safari details, pricing, payment schedule, and cancellation policy.

4.3 Accuracy of Information

You are responsible for providing accurate information, including names, contact details, dietary requirements, and mobility considerations. Errors may affect service delivery and may not be correctable without additional charges.

5. Pricing and Payment Terms

5.1 Pricing

Safari prices are quoted in Malaysian Ringgit (MYR) and include naturalist guidance, specified meals, accommodation (multi-day programs), and activities as outlined in program descriptions. Prices exclude personal expenses, gratuities, travel insurance, and transportation to/from Kota Kinabalu.

5.2 Payment Schedule

Payment terms vary by program:

Dawn Cruise: Full payment due at booking
3-Day Safari: 50% deposit at booking, balance due 14 days before safari date
7-Day Expedition: 30% deposit at booking, balance due 30 days before safari date

5.3 Payment Methods

We accept bank transfers, credit cards (processed through secure third-party payment processors), and other payment methods as specified during booking.

5.4 Currency Fluctuations

Prices are subject to currency exchange rate fluctuations for international bookings. Final charges in your local currency may vary based on payment processor rates.

6. Cancellation and Refund Policy

6.1 Cancellation by Guest

Cancellations must be submitted in writing (email). Refund amounts depend on cancellation timing:

More than 30 days before safari: Full refund minus 10% administrative fee
15-30 days before safari: 50% refund
7-14 days before safari: 25% refund
Less than 7 days before safari: No refund

6.2 Cancellation by Kalevista

We reserve the right to cancel safaris due to weather conditions, insufficient bookings, safety concerns, or circumstances beyond our control. In such cases, you will receive a full refund or the option to reschedule to an alternative date.

6.3 No-Show Policy

Failure to appear for a confirmed safari without prior cancellation results in forfeiture of all payments.

7. Safari Services and Program Details

7.1 Service Scope

Safari programs include activities and services as described in program specifications. Itineraries may be adjusted based on weather, wildlife activity, safety considerations, or operational requirements.

7.2 Wildlife Viewing

Wildlife observations are subject to natural patterns and environmental conditions. We cannot make claims regarding specific animal sightings. Our naturalists employ best practices for wildlife observation but outcomes depend on factors beyond our control.

7.3 Schedule Changes

We reserve the right to modify safari schedules, routes, or activities for safety, operational, or environmental reasons. Significant changes will be communicated as promptly as possible.

8. Guest Responsibilities and Conduct

8.1 Health and Fitness

You are responsible for ensuring you are physically capable of participating in safari activities. Inform us of any medical conditions, mobility limitations, or dietary requirements that may affect your participation.

8.2 Conduct Standards

Guests must follow naturalist instructions, wildlife observation protocols, and safety guidelines. Disruptive behavior, failure to follow instructions, or actions endangering wildlife or other guests may result in removal from the safari without refund.

8.3 Equipment and Personal Belongings

You are responsible for your personal belongings. We are not liable for loss, theft, or damage to personal items during safaris.

9. Safety and Liability

9.1 Safety Protocols

We implement comprehensive safety measures including equipment inspections, weather monitoring, and emergency procedures. Guests must comply with all safety instructions.

9.2 Assumption of Risk

Wildlife safaris involve inherent risks including unpredictable animal behavior, weather conditions, river navigation hazards, and outdoor activity risks. By participating, you acknowledge and accept these risks.

9.3 Limitation of Liability

To the maximum extent permitted by law, Kalevista's liability for any claims arising from safari services is limited to the amount paid for the specific safari. We are not liable for indirect, consequential, or incidental damages.

9.4 Travel Insurance

We strongly recommend purchasing comprehensive travel insurance covering medical expenses, trip cancellation, and personal liability. We are not responsible for costs arising from medical emergencies or trip interruptions.

10. Intellectual Property

All content on our website, including text, images, logos, and program descriptions, is owned by Kalevista and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

Photographs and videos taken during safaris are for personal use. Commercial use of images depicting our services, guides, or branded materials requires prior authorization.

11. Privacy and Data Protection

Our collection, use, and protection of personal information is governed by our Privacy Policy. By using our services, you consent to data processing as described in that policy.

12. Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including natural disasters, severe weather, political instability, health emergencies, or government restrictions. In such cases, we will offer rescheduling options or refunds as circumstances permit.

13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of Malaysian courts.

Before pursuing legal action, parties agree to attempt good-faith resolution through direct communication with Kalevista management.

14. General Provisions

14.1 Entire Agreement

These Terms and Conditions, along with booking confirmations and referenced policies, constitute the entire agreement between you and Kalevista.

14.2 Severability

If any provision of these terms is found unenforceable, the remaining provisions continue in full force and effect.

14.3 Waiver

Failure to enforce any provision does not constitute waiver of that provision or our right to enforce it in the future.

14.4 Assignment

You may not transfer your booking or obligations under these terms without our written consent. We may assign our rights and obligations to affiliated entities or successors.

15. Changes to Terms

We may update these Terms and Conditions to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated through website notices or direct email to guests with confirmed bookings.

Continued use of our services after changes become effective constitutes acceptance of updated terms.
